Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and TATOS Technologies Private Limited (“tapmenu”, “we”, “us”, or “our”), governing your access to and use of the tapmenu platform, including the website at tapmenu.me, all associated subdomains, APIs, mobile interfaces, and any related services (collectively, the “Service”).

By creating an account or using the Service in any way, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service. These Terms are governed by the laws of India, specifically the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019.

1. Eligibility

To use tapmenu, you must:

  • Be at least 18 years of age
  • Have the legal authority to enter into binding contracts
  • Be operating or managing a legitimate food service, restaurant, café, cloud kitchen, or related business
  • Not be located in any country subject to a government embargo or designated as a “terrorist-supporting” country
  • Not be barred from receiving services under the laws of any applicable jurisdiction

If you are registering on behalf of a company, partnership, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Account Registration & Security

When you register:

  • You must provide accurate, complete, and current information. Providing false information is a breach of these Terms.
  • You are responsible for maintaining the confidentiality of your login credentials. You must not share your password with any third party.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at [email protected] if you suspect any unauthorized use of your account.
  • We reserve the right to disable accounts with inaccurate information or that violate these Terms.
  • Each account is for a single individual or entity. You may manage multiple restaurant organizations under one account, subject to your plan limits.

3. The Service

tapmenu provides a digital menu management platform that enables restaurant owners and their teams to:

  • Create and publish digital menus accessible via QR code, link, or subdomain
  • Manage menu items, categories, pricing, and availability in real-time
  • Customize menus with themes, branding, and display preferences
  • Invite and manage team members with role-based access controls
  • Use AI-powered tools for menu scanning and description generation
  • Offer customers a digital ordering experience

We reserve the right to modify, add, or discontinue features of the Service at any time. We will provide reasonable notice of material changes.

4. Subscription Plans & Billing

4.1 Free Plan

tapmenu offers a free Starter plan with limited features. The Starter plan is provided “as is” and may be modified or discontinued with 30 days’ notice.

4.2 Paid Plans

Paid subscription plans (Growth, Pro) are billed on a monthly or annual basis as displayed at the time of purchase. Prices are subject to change with 30 days’ advance notice. Price changes will not apply to active subscription periods already paid for.

4.3 Billing & Payment

Payments are processed by Dodo Payments. By subscribing, you authorize Dodo Payments to charge your payment method on a recurring basis. All prices are displayed in the currency shown at checkout. You are responsible for any applicable taxes (including GST where applicable under Indian law).

4.4 Refund Policy

Subscription fees are non-refundable except where required by applicable law (including India’s Consumer Protection Act, 2019). If you cancel your subscription, you will retain access until the end of the current billing period. No partial refunds are issued for unused time. For billing disputes, contact us at [email protected] within 30 days of the charge.

4.5 Plan Limits

Each plan includes specific limits on the number of organizations, menu items, and features available. Exceeding plan limits may result in prompts to upgrade. We will not automatically charge you for overages without your explicit consent.

4.6 Cancellation

You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period. After cancellation, your account is downgraded to the free Starter plan. Your data is retained for 30 days after the billing period ends before any deletion.

4.7 Failed Payments

If a payment fails, your account may enter a “Past Due” status. We will notify you and provide a reasonable period to update your payment method. Persistent failure to pay may result in suspension of paid features.

5. User Content & Intellectual Property

5.1 Your Content

You retain full ownership of all content you upload to tapmenu, including menu item names, descriptions, prices, images, logos, and restaurant information (“User Content”). We claim no ownership over your content.

5.2 License to tapmenu

By uploading content, you grant TATOS Technologies Private Limited a non-exclusive, worldwide, royalty-free, sublicensable license to store, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service (e.g., rendering your public menu page, processing images for the CDN). This license ends when you delete the content or terminate your account.

5.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the right to use all content you upload
  • Your content does not infringe any copyright, trademark, or other intellectual property right
  • Your content is accurate (including menu prices and item descriptions)
  • Your content complies with applicable food safety regulations and labelling laws in your jurisdiction
  • Your content does not contain illegal, obscene, or harmful material

5.4 tapmenu Intellectual Property

The tapmenu name, logo, platform design, source code, AI models, and all related intellectual property are owned by or licensed to TATOS Technologies Private Limited. You may not copy, reverse-engineer, decompile, or create derivative works from the Service. The name “tapmenu” and “tapmenu.me” are trademarks of TATOS Technologies Private Limited.

6. Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable local, national, or international law or regulation

Publish false, misleading, or fraudulent menu information

Upload content that infringes intellectual property rights

Harass, abuse, or harm any person

Distribute malware, viruses, or harmful code

Attempt to gain unauthorized access to any part of the Service

Scrape, crawl, or use automated tools to extract data without permission

Resell or sublicense access to the Service without written authorization

Use the Service for activities unrelated to legitimate food/hospitality business

Circumvent any rate limits, security controls, or access restrictions

Impersonate another person, business, or entity

Use the Service in a way that degrades performance or availability for other users

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy, with or without prior notice, depending on the severity of the violation.

7. AI-Powered Features

Important disclaimer about AI features:

tapmenu uses Google Gemini AI for menu scanning (photo-to-text extraction) and dish description generation. These are AI-generated outputs and may contain errors, inaccuracies, or omissions.

You are solely responsible for reviewing and verifying all AI-generated content before publishing it on your menu. Accuracy of prices, ingredients, allergen information, and item names must be confirmed by you. We are not liable for any loss, damage, or customer complaints arising from inaccurate AI-generated content that you publish.

Images you upload for menu scanning are sent to Google LLC for processing under Google’s terms and privacy policy.

8. Service Availability & Uptime

We aim to maintain high availability of the Service but do not guarantee 100% uptime. The Service is provided “as is” and may experience:

  • Scheduled maintenance (we will provide advance notice where possible)
  • Unplanned outages due to technical issues, infrastructure failures, or third-party service disruptions
  • Feature changes, updates, or removals

We are not liable for any loss of business, revenue, or data resulting from Service downtime or unavailability. We recommend you maintain offline backups of critical menu information.

9. Third-Party Services & Links

The Service integrates with third-party services including Dodo Payments, Google OAuth, Google Gemini, Cloudflare R2, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties. Links to external websites on your public menu page are provided for convenience only and do not constitute endorsement by tapmenu.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT: (a) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (b) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (c) RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (d) AI-GENERATED CONTENT WILL BE CORRECT OR COMPLETE.

Some jurisdictions do not allow exclusion of implied warranties. To the extent such exclusions are not permitted under applicable Indian consumer protection law, the above limitations may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TATOS TECHNOLOGIES PRIVATE LIMITED AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business
  • Loss of data or goodwill
  • Customer complaints arising from inaccurate menu content you published
  • Service downtime or inability to access the platform
  • Unauthorized access to your account resulting from your failure to secure credentials

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO TAPMENU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 5,000 (FIVE THOUSAND RUPEES), WHICHEVER IS GREATER.

This limitation applies regardless of the form of action (contract, tort, strict liability, or otherwise). Where Indian consumer protection law mandates higher liability, those provisions will prevail.

12. Indemnification

You agree to indemnify, defend, and hold harmless TATOS Technologies Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service in violation of these Terms
  • Your User Content (including IP infringement or false information)
  • Your violation of any applicable law or third-party rights
  • Your restaurant’s operations, food quality, hygiene, or regulatory compliance

tapmenu is a platform provider and is not a party to transactions between your restaurant and your customers. You are solely responsible for the food, service, and operations of your restaurant.

13. Termination

By you: You may delete your account at any time from the account settings. Upon deletion, your active subscription (if any) will be cancelled, and your data will be retained for 30 days before permanent deletion, subject to the retention obligations in our Privacy Policy.

By us: We may suspend or terminate your account immediately, without notice, if you:

  • Materially breach these Terms
  • Engage in fraudulent, abusive, or illegal activity
  • Fail to pay subscription fees after a reasonable cure period
  • Cause harm to the platform or other users

We may also terminate the Service entirely with 60 days’ advance notice to all users.

Effect of termination: Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive (including intellectual property, limitation of liability, indemnification, and governing law) will survive termination.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Informal Resolution

Before initiating formal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally. We will make a good-faith effort to resolve complaints within 30 days.

14.3 Jurisdiction

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the competent courts in India. If you are a consumer under the Indian Consumer Protection Act, 2019, you may also approach the appropriate Consumer Disputes Redressal Commission.

14.4 EU / UK Users

If you are a consumer in the European Union or United Kingdom, nothing in these Terms affects your statutory rights under applicable EU or UK consumer protection law, including any right to bring proceedings in the courts of your country of residence.

15. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you via email at least 14 days before the changes take effect, and post a notice within the platform. If you continue to use the Service after the effective date, you are deemed to have accepted the revised Terms. If you do not agree to the changes, you must stop using the Service and may delete your account before the effective date.

16. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and tapmenu regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure. We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, strikes, war, internet or power outages, or government actions.

Language. These Terms are provided in English. In case of any conflict between an English version and any translation, the English version shall prevail.
